NCIA Involved in Federal Court Decisions

District of New Jersey: NCIA was recently involved in a case where a career offender was facing a 12 1/2 to 15 1/2 year sentence. Kathleen O'Boyle, NCIA Mitigation Specialist, put forth a recommendation to the Court for a 63 month term of imprisonment, based on the defendant's limited role and long history of drug addiction, which was ultimately imposed. Eastern District of New York: NCIA was recently involved in a significant sentencing decision in the Eastern District of New York. Herb Hoelter, CEO, played a key role in advising defense counsel to ask for a split sentence recommendation on a term of 24 months. The Honorable I. Leo Glasser sentenced the defendant to a term of imprisonment for 24 months and directed that the sentence “…be served in the custody of the Bureau of Prisons for a year and a day and the balance thereof in home confinement.”

The rationale for the sentence was based upon the defendant’s significant personal and professional background. (See PDF of Opinion)
